BOC seeks inputs on fees for services of customs personnel

The Bureau of Customs (BOC) is seeking inputs on a proposed customs administrative order (CAO) covering fees for services rendered by Customs personnel.

The draft CAO aims to identify and provide uniformity in the different fees; collate fees and charges from various BOC memos and orders; and rename a few charges.

The draft will cover all service fees, dues and charges collected by BOC from shipping lines, airlines, air express operators, importers, exporters, customs brokers, freight forwarders, consolidators, deconsolidators, logistics providers, transshippers, terminal operators, operators of customs bonded warehouses and other customs facilities and warehouses (CFW), free zone locators or registered enterprises, value-added service providers, and all other parties served by the bureau.

Stakeholders have until August 15 to submit their position papers on the draft CAO. A virtual public consultation will also be held on that day.

Under the draft, service fees to be collected will accrue to the trust fund while the dues and charges will go to the general fund.

A customs memorandum order governing the utilization of collected service fees, including procedures for their payment to authorized customs personnel in accordance with existing auditing, accounting and other rules and regulations, will later be issued.

The 15 service fees include the following:

  • Vessel supervision fee
  • Cargo control supervision fee
  • Aircraft supervision fee
  • Free zone locator supervision fee
  • Authorized Economic Operator (AEO) annual supervision fee
  • Underguarding fee for transfers
  • Administrative fee on cargo transit bound for free zones
  • Special flight supervision fee
  • Bulk and break-bulk discharge port survey fee
  • Export declaration processing fee
  • Super Green Lane (SGL) processing fee for list of importables
  • Service and storage fees (for in-bond baggage)
  • CFW fee
  • monitoring and supervision fee

Customs dues and charges are the following:

  • Goods declaration for transit charge (formerly cargo transfer fee)
  • Charge of customs documentary stamp
  • Processing charge for consolidated balikbayan box
  • Processing charge for returning resident
  • Import processing charge (formerly import processing fee)
  • Refund processing charge
  • Appeal fee
  • Request for legal opinion
  • Registration or accreditation charge for new application or renewal
  • Third parties annual registration charge
  • AEO application charge
  • Accreditation or renewal charge by the value-added service provider
  • Cancellation or modification of goods declaration charges
  • Amendment of manifest/bill of lading (BL)/air way bill (AWB) charges
  • Request for creation of staging BL/AWB
  • Charge for every request for advance ruling (classification and rules of origin)
  • Permit charges to take cigars/ cigarettes aboard ship, secured by/ given to persons, other than the passengers
  • Permit charges for transshipment of cigar and/or cigarettes
  • Administrative charges for co-loading
  • Condemnation of cargoes
  • Registration and participation in public bidding
  • Customs broker registration charge (sole proprietorship)
  • Registration of general professional partnership of customs broker
  • Intellectual property right recordation charge
  • Certification charge
  • Service charge for issuance of certified true copy of document

Other fees and charges collected pursuant to executive orders issued by the President with specific utilization or purposes include the SGL service fee and container security fee. – Roumina Pablo
