The Bureau of Customs (BOC) has filed criminal complaints before the Department of Justice (DOJ) against two importers for alleged misdeclaration and unlawful importation of counterfeit cigarettes and hazardous chemicals worth a combined P115 million.

The case against Goldlink Int’l Subic, Inc. involves misdeclaration and unlawful importation of over P111 million worth of counterfeit cigarettes on June 20 and 23, 2021 at the Port of Subic, BOC said in a statement.

Unlawful importation of counterfeit cigarettes is a violation of Republic Act No. 10863, otherwise known as the Customs Modernization and Tariff Act (CMTA), in relation to Customs Memorandum Order No. 20-2006; RA 10963 or the Tax Reform Acceleration and Inclusion Law; National Tobacco Administration (NTA) Board Resolution 079-2005; NTA Memorandum Circular No. 03-2004; and the Intellectual Property Code of the Philippines.

Lion King Industrial Corp. is also facing a complaint for misdeclaration and unlawful importation of hazardous chemicals worth P3.8 million on June 9, 2021 at the Manila International Container Port.

The importer allegedly violated pertinent provisions of the CMTA in relation to RA 6969, or the Toxic Substances and Hazardous and Nuclear Wastes Control Act of 1990, and its implementing rules and regulations, as implemented by Department of Environment and Natural Resources Administrative Order No. 1992-29, and AO No. 2013-24.

To date, BOC said 73 criminal cases have already been filed before the DOJ against 237 individuals and customs brokers for alleged smuggling.
