Denied franchise truck applications may be refiled at LTFRB

ID-10033899The Land Transportation Franchising and Regulatory Board (LTFRB) said operators of trucks for hire with non-port related services whose applications for franchise have been dismissed still have a chance to secure a certificate of public convenience (CPC).

In an advisory, LTFRB said denied applicants must secure an Order of Dismissal from the agency’s Information System and Management Division (ISMD) then follow these steps:

  • File for a Motion for reconsideration within 15 days from receipt of order from Window 4 (technical division).
  • Secure Notice of Hearing from Window 12 within five days of filing for Motion for Reconsideration.
  • Publish the Notice of Hearing in a newspaper of general circulation five days before scheduled date of hearing.
  • Attend the hearing then file formal Offer of Evidence of documentary requirements.

As for trucks for hire with port related services whose applications were also dismissed, LTFRB, under Board Resolution No. 06-2014, said they can still file for a Motion for Reconsideration for Issuance of Provisional Authority. They are also required to present the Permit to Operate (PTO) from the Philippine Ports Authority, as identification that they are trucks servicing the ports. The PTO is an annual clearance that truckers must renew from the port authority.

The resolution also extends the application for franchise and validity of PAs of trucks with port-related services to January 31, 2015 to help in decongesting the ports.
