A declaration of goods for warehousing must now be filed by a warehouse operator within five days of the shipment’s transfer to the storage at the port of entry, according to the Bureau of Customs (BOC).

This comes after BOC’s Management Information System and Technology Group (MISTG) implemented on March 28 the five-day period for filing the warehousing declaration in the E2M System.

Failure to do so will result in the tagging of the shipment as “abandoned” in the E2M System, according to MISTG Memo No. 05-2023 dated March 27.

The procedure is pursuant to Customs Administrative Order No. 01-2022, which provides the amended guidelines on the establishment, operation, supervision, and control of customs bonded warehouses (CBWs).

Section 8.1 of the CAO states that the warehouse operator should file the goods declaration for warehousing within five days from the date of transfer.

The warehousing declaration should be filed at the port where the goods to be stored are discharged. In cases where the goods are under the jurisdiction of another port of entry, a goods declaration for transit must be filed for the transfer of the goods from the port of discharge to the port of entry.

CAO 01-2022 covers all types of CBWs listed in the Customs Modernization and Tariff Act (CMTA), as well as those to be created by the secretary of finance at the recommendation of the customs commissioner.

CBWs are warehouse facilities authorized/licensed by BOC to import, receive and store – without payment of duties and taxes – goods, raw materials, accessories, and packing materials either for manufacture into finished products for export, or storage for the account of an accredited exporter/client. – Roumina Pablo
